Regulations of the Multioutlet.com.pl online store from 01/04/2020
The terms used in the Regulations mean:
1.1 Customer - a natural person, legal person or an organizational unit that is not a legal person, whose provisions specifically grant legal capacity, which places Orders within the Store;
1.2 Civil Code - the Act of April 23, 1964 (Journal of Laws of 2018, item 1025, as amended);
1.3 Regulations - these Regulations for the provision of electronic services as part of the Multioutlet.com.pl online store;
1.4 Online Store (Store) - website available at www.Multioutlet.com.pl, through which the Customer may in particular place orders;
1.5 Goods - products presented in the Online Store;
1.6 Sales Agreement - a contract for the sale of Goods within the meaning of the Civil Code, concluded between Multioutlet Sp. z o.o and the customer, concluded using the Store's website to conduct online sales and to provide the services necessary in this regard by electronic means.
1.7 Act on consumer rights - the Act of 30 May 2014 (Journal of Laws of 2019, item 134);
1.8 Act on the provision of electronic services - the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2019, item 123);
1.9 Order - Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and number of goods;
1.10 Consumer - means a natural person performing a legal act not related directly to his business or professional activity.
II. General provisions
2.1 These Regulations set out the rules for using the online store available at www.Multioutlet.com.pl and the rules for using the services intended for Store customers;
2.2 These Regulations are the regulations referred to in art. 8 of the Act on the provision of electronic services;
2.3 The Multioutlet.com.pl online store available at www.Multioutlet.com.pl is run by Multioutlet Sp. z OO, with its registered office in Świnoujście 72-600, ul. Wyspiański 34B, NIP: 8551582479, REGON 321194240, Multioutlet Sp. z OO or the Seller;

2.4 These regulations specify in particular
a. the rules for registering and using an account as part of an online store;
b. terms and conditions for electronic submission of Orders as part of an online store;
2.5 Using the online store is possible provided that the ICT system used by the customer meets the following minimum technical requirements:
a. Internet browsers optional: Internet Explorer, Firefox, Mozilla, Google Chrome, Opera, Safari.
b. minimum screen resolution 1024x768
c. Java Script
2.6 In order to use the online store, the Customer should on their own gain access to a computer station or terminal device with Internet access;
2.7 Pursuant to applicable law, the Seller operating the Multioutlet.com.pl store reserves the right to limit the provision of services via the Online Store to persons under 18 years of age. In this case, potential customers will be notified of the above;
2.8 Customers can access these Regulations at any time via the link on the main page of the www.Multioutlet.com.pl website and download and print it;
2.9 Information about the goods provided on the Store's websites, in particular their descriptions, technical and functional parameters as well as prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code;
III. Rules for using the Online Store
3.1 The customer has the option of making purchases in the store by registering his customer account or without registration;
3.2. Registration takes place by completing and accepting the registration form provided on the Store's website;
3.2.2 By registering an account, the customer gains access to their purchase history and permanent access to their personal data and the ability to modify them independently for the period in which the administrator is entitled to process them in connection with the implementation of obligations under the law in the field of sales documentation. In addition, the customer account allows easy return or complaint of purchased products.
3.2.3 Registered Customer account in the absence of shopping activity is deleted after 5 years from the last purchase.
3.2.4 The Customer may at any time ask the administrator to delete his Customer account by sending an e-mail to the administrator: kontakt@Multioutlet.com.pl
3.3 In the case of purchases without registration, the Customer will receive a login and password with the confirmation message of placing the order, which will enable him to set up a Customer Account at the stage of order finalization, e.g. to track the stage of order completion, change of delivery address or return or complaint of purchased products.
3.4 The administrator of the Store's customer database is Multioutlet Sp. z o.o with headquarters in Warsaw at ul. Marywilska 44 Hall A133;
Customers' personal data are processed on the basis of art. 6 clause 1 lit. b) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC, i.e. to performance of the sales contract on the terms set out in these Regulations and in order to take action at the request of the data subject before concluding the contract for the period necessary for its implementation in accordance with the Regulations and at a later time for the period necessary to achieve the objectives provided for in the provisions of generally applicable law .
Customers' personal data is stored for the period necessary to perform the order on the principles set out in the Regulations, taking into account the deadlines resulting from the administrator's implementation of legal obligations in the field of online sales. Providing personal data is voluntary, but necessary to perform the sales contract. Failure to provide data will prevent the order from being processed. Personal data to the extent necessary to perform the service may be made available to entities providing support to the administrator on the basis of commissioned services in accordance with concluded processing entrustment agreements as well as to entities and bodies authorized under applicable law.
3.5 When expressing separate consent by the Buyer, the personal data provided may be used for another purpose within the scope indicated in the content of the consent;
3.6 The customer during registration or at a later time by ticking the appropriate box can agree to receive e-mail newsletter and / or sms newsletter . Expressing the above consent is tantamount to consenting to the processing of personal data by the Seller, for the purpose of direct marketing of its own products and for sending to the provided e-mail address and / or telephone number by electronic means and / or using telecommunications terminal equipment, commercial information specified in the Act of 18 July 2002 on the provision of electronic services from Multioutlet Sp. z o.o with headquarters in Warsaw. The consent is voluntary and may be revoked at any time. Unsubscribing from the e-mail and SMS newsletter;
3.7 The Customer, by completing the payment form for ordered products, may additionally agree by checking the appropriate box  for:
a. processing personal data in the form of an email address by Multioutlet Sp. z o.o, with its registered office in Warsaw, ul. Marywilska 44 Hall A133, to complete the survey with an opinion on the product purchased / transaction made in the Multioutlet.com.pl store and to place it on the Store's website. The above consent is voluntary and may be revoked at any time in the details of the order;
3.8 Customers who have registered a Customer account have permanent access to their data and the ability to correct them by logging into their account via the website www.Multioutlet.com.pl. Regardless of having a Customer account, each Customer also has the right to request access to the information provided by them constituting personal data, the right to rectify (correct), delete or limit processing, the right to object to the processing, as well as the right to transfer data. The buyer also has the right to withdraw his consent at any time without affecting the lawfulness of the processing based on consent before its withdrawal and the right to lodge a complaint with the supervisory authority. The possibility of exercising your rights depends essentially on the legal grounds on which the specific processing is based. 3.9 The Seller may deprive the Customer of the right to use the Online Store, as well as limit his access to part or all of the resources of the Online Store, with immediate effect, in the event of the Customer's violation of the Regulations, in particular when the Customer:
a. provided during registration in the online store that the data was false, misleading or infringing the rights of third parties;
b. has committed, through the online store, infringement of the personal rights of third parties, in particular the personal rights of other customers of the online store;
3.10. A person who has been deprived of the right to use the online store may not register again without the prior consent of the Seller.
3.11 The Customer is obliged in particular to:
a. not to provide or transfer content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties;
b. using the Online Store in a way that does not interfere with its functioning, in particular through the use of specific software or devices;
c. not to take actions such as: sending or placing unsolicited commercial information (spam) as part of the online store;
d. using the Online Store in a way that is not inconvenient for other customers and for the Seller;
e. use of any content posted as part of the online store only for personal use;
f. using the online store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet;
3.12 By accepting the regulations, you agree to receive electronic invoices required by the Act of March 11, 2004. about tax on goods and services.
3.13. The Contact tab contains contact details for the data protection administrator, who supervises the security of personal data processed by Multioutlet Sp. z OO. In the event of a possible violation of your rights, please contact us. In the interests of the security of our clients' data, all observations will be promptly checked to ensure the highest level of protection for processed data.
IV. The procedure of concluding a sales contract and order processing
4.1 In order to conclude the Sales Agreement via the Online Store, go to the website www.Multioutlet.com.pl, select the product, its brand, color and size, taking further technical actions based on the messages displayed to the customer and information available on the website;
4.2 The choice of Goods ordered by the Customer is made by adding them to the basket;
4.3 When placing an Order - until the "Place Order" button is pressed - the Customer has the option of modifying the entered data and regarding the selection of the Good, as well as deciding whether he needs a VAT Invoice. Receipt of a document confirming a purchase in the form of a VAT invoice is possible only after providing the NIP number. For this purpose, follow the displayed messages and information available on the website;
4.4 After the Customer using the Online Store has provided all necessary data, a summary of the order will be displayed. The summary of the order will contain information on:
a. subject of the order,
b. unit and total price of ordered products and delivery costs,
c. the chosen payment method,
d. the selected delivery method,
e. delivery time
4.5 In order to send the Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "I am ordering, to pay" button;
4.6 If the Customer has given the consent referred to in point 3.9 lit. a) within 14 days of placing the order, the e-mail address indicated in the order may receive, information containing a request to post an opinion on the purchased product and / or the transaction made in the Multioutlet.com.pl store, which may be placed on the Multioutlet.com.pl website;
4.8 The sending of the Order by the Customer constitutes a declaration of will to conclude with Multioutlet Sp. z OO. Contract of sale in accordance with the Regulations;
4.9 The sales contract is concluded in Polish, in accordance with the Regulations.
5.1 Delivery of ordered goods takes place via: Poczta Polska through delivery to the customer's home, courier D PD; logistics operator "InPost parcel lockers, only in the territory of the Republic of Poland, and personal pickup in a stationary store at 44 Marywilska Street, Hall A133 in Warsaw 03-042. Delivery costs are each time added to the basket with the goods ordered.
5. 2 Delivery deadline is 1 to 5 business days from the day the Customer sends the Order;
5.3 Customers can access these regulations at any time via the link on the main page of the Multioutlet.com.pl website and download it and print it.
VI. Prices and payment methods
6.1 The prices of the Goods are given in Polish zlotys and contain all components, including VAT (with distinction of the rate), customs duties and all other components;
6.2 The Customer may pay the order fee using:
a. transfer to the bank account number: SANTANDER: account number:
06 1090 1492 0000 0001 1854 1825, then after placing the order the Customer will receive an email with the transfer details, have 2 days to complete it, after that time if the payment is not recorded on our account, the product reservation will be completed.
b. Paypal payments; PayU - instant payments
c. in cash and with a card when picking up in a stationary store;
6.3 Orders with the cash on delivery option (cash on delivery) are only available up to a maximum of PLN 5,000. Orders for amounts exceeding the PLN 5,000 threshold are carried out only with the option of prepayment.
VII. Statutory right of withdrawal
7.1. The consumer has the right to withdraw from the concluded sales contract within 14 days, the costs associated with the return shall be borne by the buyer.
7.2. The deadline for withdrawal: a) from the sales contract begins with taking possession of the Goods by the Consumer or a third party indicated by him other than the carrier, and in the case of a sales contract that includes many Goods that are delivered separately, in lots or in parts - from taking possession of the last item, lot or part, b) for other contracts - from the date of the contract.
7.3. The consumer may withdraw from the contract by submitting to the Seller a statement of withdrawal from the contract (by submitting a statement on the Store's website). To meet the deadline, it is enough to send a statement before its expiry.
7.4. In the event of withdrawal from the sales contract, the contract is considered void.
7.5. The Seller shall immediately, not later than within 14 days from the date of receipt of the Consumer's statement on withdrawal from the contract, return to the Consumer all payments made by him, excluding the costs of delivery of the Goods, subject to point 8.7. The Seller shall refund the payment using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of return that does not involve any costs for him. The Seller will withhold the reimbursement until receipt of the Good.
7.6. The seller is not obliged to refund the additional costs incurred by the consumer related to the return of the purchased goods.
7.7. The consumer is obliged to return the Merchant's Goods together with the original proof of purchase immediately, but not later than 14 days from the day on which he withdrew from the contract. 7.8. The consumer is obliged to bear the direct costs of returning the good.
7.9. The consumer is responsible for reducing the value of the Good as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Good.
VIII. Complaints about the Goods and warranty
8.1 In most cases, the goods sold are free from defects, otherwise the Seller informs in the product description about the defects or marks formed on the products
8.2 The Seller is obliged to deliver Goods free of defects and is responsible to the Customer who is a Consumer for physical or legal defects of the purchased Good (warranty) on the principles set out in the Civil Code and the Act on consumer rights, unless he informs existing defects in the product description. The Seller's liability under the warranty is excluded in relation to Customers who are not Consumers and also in a situation where the Seller informs about existing defects in the goods sold.
8.3 Complaints about purchased Goods may be submitted, for example: by e-mail to the address (kontakt@Multioutlet.com.pl) or in writing by letter to the address: Multioutlet Sp. z o. o. ul. Marywilska 44 Hall A133, 03-042 Warsaw
8.4 When submitting a complaint, the Seller recommends providing customer contact details, accurately describing the reasons for the complaint and requests to the Seller, as well as attaching a document confirming the sale or photocopies thereof.
8.5 The Seller undertakes to consider each complaint within 14 days of its receipt. The Seller undertakes to inform the Buyer about the actions taken and the result of the complaint.
8.6. The Customer who exercises the warranty rights is obliged to deliver the defective item, at the Seller's expense, to the following address: Multioutlet Sp. z o. o. ul. Marywilska 44 Hall A133, 03-042 Warsaw.
8.7 In the event of a justified complaint, the cost of replacement or repair, including the cost of delivery related to a complaint of a Good, shall be borne by the Seller.
8.8 In the complaint procedure, the Seller does not provide for the possibility of out-of-court settlement of the dispute.
8.9 Multioutlet Sp. z OO is not a producer of Goods.
IX. Complaints regarding the provision of electronic services.
9.1 Multioutlet Sp. z o. o. undertakes actions to ensure fully correct operation of the Store, to the extent that results from current technical knowledge and undertakes to remove within a reasonable time any irregularities reported by customers;
9.2 The Customer is obliged to immediately notify Multioutlet Sp. z o.o about any irregularities or interruptions in the operation of the Online Store website;
9.3. Irregularities related to the functioning of the Store may be reported by the Customer in writing to the following address: ul. Marywilska 44 Hala A133, 03-042 Warsaw by e-mail to the following address: kontakt@Multioutlet.com.pl or using the contact form;
9.4 In the complaint, the Customer should provide his name, correspondence address, type and date of irregularities related to the functioning of the Store;
9.5 Multioutlet Sp. z o.o undertakes to consider each complaint within 14 days, and if this was not possible, to inform the customer within this period when the complaint will be considered;
X. Final provisions
10.1 Multioutlet Sp. z o.o is the owner of all product photos, graphics, logos and has full copyright to them. Multioutlet Sp. z o. o. also has the appropriate licenses to use the images used to create advertising banners. Copying, altering, sharing and publishing, as well as using for sale purposes is prohibited and may result in criminal penalties. Multioutlet Sp. z OO does not allow their use, distribution and distribution without the knowledge and written consent under pain of claims for copyright infringement and theft of intellectual property;
10.2 Settlement of any disputes arising between Multioutlet Sp. z o.o and the customer who is a consumer within the meaning of art. 221 of the Civil Code, is submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure
10.3 Settlement of any disputes arising between Multioutlet Sp. z o. o. running an online store and a customer who is not a consumer within the meaning of art. 221 of the Civil Code, is subject to the courts with jurisdiction over the seat of Multioutlet Sp. with OO
10.4 Pursuant to Regulation (EU) No 524/2013 of the European Parliament and of the Council of May 21, 2013 on the online system of settling consumer disputes and amendments to Regulation (EC) No 2006/2004 and Directive 2009/22 / EC (Regulation on ODR in consumer disputes) (Journal of Laws EU.L No. 165, p. 1), Customers have the right to settle disputes with entrepreneurs concluding online sales contracts or contracts for the provision of services out of court through the EU online platform.
10.5 A customer who is a consumer from the Republic of Poland shall have the right to examine complaints and pursue claims: 1) through mediation activities of voivodship trade inspection inspectors, 2) before permanent amicable consumer courts at voivodship trade inspection inspectors.
10.6 In matters not covered in these Regulations, the provisions of Polish law shall apply, including the Civil Code, the Act on the provision of electronic services, the Act on copyright and related rights, and other relevant provisions of Polish law.
10.7 The parties exclude the application of the United Nations Convention on Contracts for the International Sale of Goods.
Information regarding online dispute resolution pursuant to Art. 14 Para. 1 of the ODR (Online Dispute Resolution Regulation):
The European Commission gives consumers the opportunity to resolve online disputes pursuant to Art. 14 Para. 1 of the ODR on one of their platforms. The platform (http://ec.europa.eu/consumers/odr) serves as a site where consumers can try to reach out-of-court settlements of disputes arising from online purchases and contracts for services.
